The General Terms and Conditions of Sale (GTC) set forth below shall govern all orders placed through our online store.
These general terms and conditions have been drafted in accordance with the provisions of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, and Royal Legislative Decree 1/2007, of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws.

**ARTICLE 2 - Purpose**
The purpose of these GTC is, on the one hand, to inform potential buyers of the conditions and modalities under which BIOEIVISSA NATURAL proceeds with the sale and delivery of the requested products, and on the other hand, to define the rights and obligations of the parties within the framework of product sales.
BIOEIVISSA NATURAL reserves the right to unilaterally modify these GTC at any time. However, the GTC applicable to the Order will be those that the Buyer has accepted at the time of placing the Order.
These GTC are complemented by the general terms of use of the Website and the provisions of the Privacy Policy and the Cookie Policy.
You can place our products in the shopping cart without commitment and correct any errors before confirming your order. The contract will be considered concluded when you click the purchase button. Subsequently, you will receive an email confirmation of the receipt of your order.
**ARTICLE 3 - Contract Formation and Orders**
**3.1 Rates**
The sale price, indicated in euros, of the products offered on the BIOEIVISSA NATURAL Website will be the price in effect at the time of placing the order. This price may be modified by BIOEIVISSA NATURAL at any time to adapt to current rates, and the price that will apply to the purchase is the one displayed on the screen at the time of placing the Order.
The price does not include shipping costs, which will be billed as a supplement to the price of the purchased products if necessary. Shipping costs will be indicated before the Buyer registers the Order. The different delivery and shipping modalities are established in section 5.1 of these GTC and will be recalled on the Website. Shipping modalities may be modified by BIOEIVISSA NATURAL at any time. Therefore, BIOEIVISSA NATURAL recommends that buyers consult the GTC on the Website.
Prices include Value Added Tax (VAT).
**3.2 Availability**
The products displayed on the Website will be valid while they remain advertised on it and, in any case, until stocks last. For products not in our warehouses, the validity of the offers presented by BIOEIVISSA NATURAL will be subject to the availability of the products. At the time of placing the Order, the Buyer will be provided with information, in principle, about the availability of the products. Since this information comes directly from our suppliers, errors or modifications may exceptionally occur, and the Buyer will not have real information until the time of purchase.
In any case, in the event of total or partial unavailability of the products after the Order has been placed, the Buyer will be informed by email or telephone as soon as possible of the unavailability of such product and will be offered either a similar substitute product or the option to cancel the Order in whole or in part.
In case of total cancellation of the Order:
The Buyer's Order will be automatically canceled, and if payment has not been made, no charge will be made to their bank account.
The BIOEIVISSA NATURAL Customer Service will contact the Buyer to inform them of the cancellation of their Order and offer them the possibility of renewing the Order, except for the unavailable product.
If payment has already been made, the Order may be canceled as long as it has not left the BIOEIVISSA NATURAL facilities, in which case the Buyer will be refunded the total amount of the Order as soon as possible. If the Order has already been prepared, the Buyer must accept the Order and has 24 hours to return the Order in whole or in part, with the shipping costs of the return at their expense.
In case of partial cancellation of the Order:
1- The Buyer's Order will be validated, and the full amount of the Order will be charged to their bank account.
2- The available products will be delivered to the Buyer.
3- The price of the requested product that is not available will be refunded to the Buyer as soon as possible.
**3.3 Order**
Placing an Order implies acceptance of these GTC, the provisions set forth in the Legal Notice, and declares that the Buyer has read and is aware of the Privacy Policy and the Cookie Policy, without prejudice to the particular conditions that the Parties may agree upon.
The Buyer will have the possibility to check the details of their Order and correct any errors.
From the moment the Buyer confirms their Order by clicking on the "Confirm and pay" icon, it will be considered that they have knowingly accepted the content and conditions of the Order in question and, in particular, these General Terms and Conditions of Sale and the fact that their Order implies a payment obligation for them.
The Buyer will receive an email at the time of confirmation of their Order. This will be sent to the email address provided for identification during the registration process, prior to placing the Order.
On the other hand, BIOEIVISSA NATURAL assumes no responsibility in case of an error in entering the email address or non-receipt of the Order confirmation email. In these cases, the sale will be final, except in the case of Order cancellation by BIOEIVISSA NATURAL, especially in the case of unavailable products. However, the Buyer may exercise their right of withdrawal under the conditions set forth in Article 6 of these General Terms and Conditions of Sale.
**ARTICLE 4 - Payment**
**4.1 Payment Methods - Bank Cards**
The payment methods through which purchases can be made on the Website are bank card and bank transfer. The bank cards accepted on the BIOEIVISSA NATURAL Website are the following: Visa and MasterCard.
All bank card holders are subject to validation and authorization checks by the card issuer. If the Buyer's payment card issuer declines, or for any reason does not authorize the payment in our favor, either before or after a payment, we will not be responsible for any delay or non-delivery.
**4.2 Payment Modalities**
All Orders must be paid in euros, including all taxes and mandatory duties. Bank charges will be borne by the Buyer, if applicable.
**4.3 Security in Payment Operations**
To ensure the security of payments made by bank card, the Buyer must communicate to BIOEIVISSA NATURAL the visual cryptogram (CVV) that appears on the back of the bank card used by the Buyer.
As part of the fight against Internet fraud, data related to the Buyer's Order may be communicated to third parties authorized by law or designated by BIOEIVISSA NATURAL, solely for the purpose of verifying the Buyer's identity, as well as the validity of the Order, the payment method used, and the intended delivery.
BIOEIVISSA NATURAL uses a secure payment tool called "ADYEN". Payment security is based on Buyer authentication and the confidentiality of all data. To ensure this security, the tool uses proven cryptographic techniques and complies with the requirements established in the various banking regulations applicable in Spain.
**ARTICLE 5 - Delivery and Receipt**
**5.1 General Provisions**
The products requested by the Buyer in accordance with the provisions of these GTC may be delivered or collected, at the Buyer's choice, as follows:
- At the address indicated by the Buyer as the delivery address for the corresponding Order.
BIOEIVISSA NATURAL only delivers to Spain, including the Balearic Islands. Deliveries are also made to the Canary Islands with an additional cost of €9.99, and to Ceuta and Melilla with an additional cost of €36.36. In this case, the Buyer or the recipient of the Order will receive the products through the transport company chosen by BIOEIVISSA NATURAL, and must sign an electronic receipt. The aforementioned electronic receipt will serve as proof of delivery of the Order by BIOEIVISSA NATURAL.
If the Buyer of the Order is absent at the address provided at the time of delivery, the transport company will attempt to deliver the package again the following business day, after having duly informed the recipient by SMS, email, and/or a notice of arrival in the postal mailbox.
In case the recipient is absent a second time at the address provided during the purchase process, the Buyer or the recipient of the Order will receive a notice of arrival, an email, and/or an SMS, informing that their Order will be available for pickup within 15 days at the corresponding transport company's headquarters.
If within 15 days from the second unsuccessful delivery attempt, the package has not been collected, it will be returned to BIOEIVISSA NATURAL, and the money will be refunded to the Buyer, through any payment method, at the choice of BIOEIVISSA NATURAL, with shipping and return costs previously deducted.
No claim regarding delivery will be accepted when the package is marked as delivered, for which the transport company's computer system will be considered conclusive evidence.
**5.1.1 Shipping Cost for Orders in IBIZA**
Orders on the island of IBIZA will have no shipping cost if they exceed SIXTY (60.00 €) euros; for orders below that amount, the shipping cost will be determined at the time of the purchase summary.
- Shipping costs of €5 for orders under €60.
**5.2 Anomalies, Damages, or Deteriorated Packages**
**5.2.1 General Provisions**
The Buyer, or the recipient of the Order, is recommended to check the external condition of the package and the products at the time of delivery.
In case of an anomaly related to the package (damaged package, open package, liquid residues, etc.) or related to the requested products (missing product(s) or damaged product(s)), the Buyer must imperatively follow the corresponding procedure, among those described below in Articles 5.3.2 and 5.3.3 of these General Terms and Conditions of Sale, according to the status of the Order. Failure to follow the appropriate procedure will exclude the possibility of recourse against the transport company and against BIOEIVISSA NATURAL. Specifically, the Buyer may not demand any refund. The Buyer, or the recipient of the Order, may also not require BIOEIVISSA NATURAL to replace the requested products.
Likewise, the Buyer or the recipient of the Order will have the possibility to call the BIOEIVISSA NATURAL Customer Service to know the modalities for the return of the damaged product(s). The Buyer will in this case be obliged to follow the procedure for the return of damaged products that has been indicated to them by the BIOEIVISSA NATURAL Customer Service. Otherwise, the Buyer may not demand a refund or replacement of the affected products.
**5.2.2 Mandatory Procedures in Case of Damaged Package**
• In case of an incident noted in the presence of the transport company:
- Reject the delivery and clearly and detailedly state the incident.
- Indicate the reason for the rejection of the delivery to the BIOEIVISSA NATURAL Customer Service.
• In case of incidents noted without the presence of the transport company:
- Communicate the anomaly within the following 24 hours of receipt of the damaged or missing package or product to the BIOEIVISSA NATURAL Customer Service through the following means:

The notification of incidents and the filing of claims must be made as soon as possible and, in any case, within 24 business hours from the delivery of the product.
**5.2.3 Mandatory Procedures in Case of Missing or Damaged Product**
The Buyer must communicate the absence or degradation of the product to the BIOEIVISSA NATURAL Customer Service through the means specified in the previous section. The BIOEIVISSA NATURAL Customer Service may request any data related to the identity of the Buyer or recipient of the Order and proceed with any necessary verifications for the case.
**5.3 Delivery Deadlines**
Delivery deadlines (24h to 48h) start from the sending of the Order confirmation email, except for payments by bank transfer, which will start counting from the receipt of the transfer by BIOEIVISSA NATURAL, and will be those communicated to the Buyer before making and confirming the purchase.
In the event that delivery deadlines are exceeded for any reason other than force majeure, the Buyer will have the possibility to cancel their Order.
**ARTICLE 6 - Rights and Withdrawal Deadlines**
**6.1. Deadline for Exercising the Legal Right of Withdrawal**
In accordance with applicable regulations, the Buyer has a period of FOURTEEN (14) days, from the date of receipt of the Order, to exercise their legal right of withdrawal without having to justify their decision.
**6.2. Products Excluded from the Legal Right of Withdrawal**
In accordance with applicable regulations, the legal right of withdrawal may not be exercised in the case of Orders related to:
- The supply of items that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection.
- The supply of fresh products for immediate consumption.
Therefore, the Buyer is warned that they may not exercise their legal right of withdrawal regarding items unsealed by the Buyer whose commercialization by BIOEIVISSA NATURAL entails risks for reasons of hygiene or health protection of consumers (e.g., personal care products, immediate consumption products, perishable food, etc.).
**6.3. Consequences of Exercising the Legal Right of Withdrawal**
When the products are eligible for the legal right of withdrawal, the Buyer who exercises their right of withdrawal under the conditions set forth in this article, both in relation to the deadline and the modalities of product return, may obtain a refund of the amount paid for the purchase of the returned products. The refund of the amount paid must be made without undue delay, and in any case, within FOURTEEN (14) calendar days from the date on which BIOEIVISSA NATURAL was informed of the withdrawal by the Buyer.
**6.4. Costs**
In accordance with applicable regulations, the costs of returning the products will be borne by the Buyer, except in the case of non-conformity of the delivered products with the Order, in which case the return costs will be borne by BIOEIVISSA NATURAL.
**6.5. General Provisions Applicable to All Return Modalities**
The products must be returned to BIOEIVISSA NATURAL in a condition suitable for their commercialization: products in perfect condition, accompanied by their original packaging, accessories, leaflet, etc., within a maximum period of fourteen (14) days from the date of receipt. Returns of products made after this period will not be accepted.
The products must be accompanied by the Order number; it is the Buyer's responsibility to pack the products so that they arrive correctly at the BIOEIVISSA NATURAL facilities.
In the event that the Buyer has benefited on the Website from an offer for purchase, by which they would be entitled, under certain conditions, to one or more products offered as a counterpart to their Order, and as a result of their exercise of the right of withdrawal, they lose the right to such offer; the Buyer must return, together with the products affected by the withdrawal, the offer product(s) received as a counterpart to their Order so that BIOEIVISSA NATURAL can take their withdrawal request into consideration.
The Buyer's liability may be required in case of depreciation of the product as a result of handling other than that necessary to establish the nature, characteristics, and, where appropriate, proper functioning of the products.
**6.6. Return to the Transport Company's Collection Points**
The Buyer who wishes to exercise their right, whether legal or contractual, of withdrawal, returning a product by courier, must follow the following instructions:
Use the original packaging for the return of the affected product(s).
Request, print, and attach the return label.
BIOEIVISSA NATURAL will not accept shipments by courier or parcel postage due.
In the event that the Buyer does not effectively demonstrate having ensured the deposit of the product with the transport company or at the establishment, the risks associated with the return of the product will be borne by the Buyer.
For any claim related to legal guarantees, the Buyer must contact the Customer Service through the means specified in these GTC.
**ARTICLE 7 - Customer Service**
For any additional information, inquiry related to the status of an Order or a return, or a claim related to an Order, you can contact the BIOEIVISSA NATURAL Customer Service by phone at 971302706 during the service hours from 9 a.m. to 5 p.m. and indicated under the heading "Contact" on the Website or by sending an email to: shop@bioeivissa.com.
**ARTICLE 8 - Personal Data Protection**
To process the Order, BIOEIVISSA NATURAL will collect the Buyer's personal data. The Buyer is hereby informed that the Data Controller of their data is BIOEIVISSA NATURAL, S.L. and that their data will be processed in accordance with the provisions of Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, and Regulation (EU) 2016/679 of April 27, 2016 (GDPR) regarding the protection of natural persons with regard to the processing of personal data and the free movement of such data, so we inform you that your data will be processed for the main purpose of maintaining and managing the contractual relationship with the Buyer. Likewise, we inform you that you have the right to access, rectify, and delete your data, as well as other rights detailed as set forth in the Privacy Policy.
